Can I Be Arrested Without a Warrant in Minnesota?

According to Minnesota Statutes 629.34, there are certain circumstances when a police officer can make an arrest without a warrant. An arrest may be made by a peace officer without a warrant under the following conditions:

  • The offense has been committed or attempted in the police officer’s presence
  • The individual arrested has committed a felony, although not in the police officer’s presence
  • The officer has reasonable cause for believing the person arrested has committed a felony
  • The offense is a gross misdemeanor violation of damage to property, check forgery, harassment, stalking or financial transaction card fraud
  • The offense is a nonfelony violation of an order for protection, violation of restraining order, or domestic violence no contact order
  • The offense is a gross misdemeanor violation of escape from custody, and the person arrested is a juvenile committed to the custody of the commissioner of corrections
  • The peace officer has a valid reason to believe that within the preceding 72 hours, exclusive of the day probable cause was established, the person has committed nonfelony domestic abuse

Under Minnesota law, an officer in the United States Customs and Border Protection or the United States Citizenship and Immigration Services may also arrest an individual without a warrant under specific circumstances specified in the same statute.

In the state of Minnesota, there are several different types of warrants that can be issued for various reasons, but the most common ones are listed below:

  • Bench Warrants: An arrest warrant is also known as a bench warrant. As stated previously, it authorizes a person’s arrest. However, it’s important to understand law enforcement will not seek you out with a bench warrant. In most cases, the offender is arrested if they’ve been pulled over in a traffic stop and the officer discovers the warrant while checking their information. Bench warrants are issued for alleged defendants who violated their pre-trial release supervision conditions, did not appear in court for a hearing or failed to follow a court order.
  • Complaint Warrants: A complaint warrant is based on a complaint filed by the criminal court. A complaint is a formal legal document that lists essential facts establishing the offense charged.
  • Probation/Parole Violation Warrants: A probation/parole warrant is issued for a defendant who is under supervision with the Sherburne County Community Corrections but has violated their supervision conditions.
